Advocating Against Taxation on Advertising: A Legislative Update from AAF Nebraska’s Legislative Committee

Earlier this year, AAF Nebraska’s Legislative Committee, along with other AAF members, actively testified at the Nebraska Revenue Committee hearings to oppose the Nebraska Advertising Service Act. Thanks to the dedicated efforts of our members and advocates, we successfully halted multiple variations of this Act within the Nebraska Legislature. Although the final bill, LB 34, was ultimately passed during the special session, it was refocused as a property tax relief measure and signed by the Governor without any new sales taxes on goods or services—including those on advertising and public relations.

Looking ahead, we are concerned that the Governor may revisit taxation initiatives next session, with a possible target of achieving 40 to 50% property tax relief. Advertising and public relations services could again be considered as sources of new tax revenue to meet this goal. The AAF Nebraska Legislative Committee is preparing by building relationships with newly elected State Senators and their Legislative Aides. We aim to ensure that lawmakers understand the critical impact that potential advertising taxes could have on our industry.

The Committee also plans to address privacy legislation, regulatory changes, and legal developments that affect Nebraska advertisers. We encourage members to stay engaged and voice opposition to legislative efforts that may harm our industry, whether through direct tax measures or additional regulatory burdens.
